課程概述 |
本課程深入研討經濟刑法之相關問題。課程安排邀請學者、檢察官、法官及第一線執法人員，分別從法理及實務層面檢討新法的問題，部分主題由修課研究生報告。課程報告子題如下述，但學期第一週將視修課同學之情形而調整所有子題並重新排定報告順序。本學期處理主題包含：金融犯罪（證交法、銀行法）、洗錢罪、違反森林法犯罪、妨害營業秘密罪、逃漏稅捐罪、收賄（政治獻金型）罪。
This course focuses on criminal issues regarding confiscation and other economic and financial criminal laws. The following subjects are some representative issues upon which the course may discuss, and all participants shall be reminded that the topics and its representation date may be rearranged depend on class situations. |

課程目標 |
藉由來自各界（審、檢、辯、調、學）不同觀點的提出，以及理論面和實務面的對話，參與修課同學可以深入瞭解具高度重要性的沒收新法，並從比較面向深入思考我國沒收立法與實務的未來走向。
By researching on economic and financial criminal laws, the course primarily aims to discuss the different and controversial aspects of The Act in order to provide a comparative view to domestic practices and legislators. |

課程要求 |
本課程進行方式，自學期中之後，皆由修課同學擔任報告主軸。修課研究生同學需挑選一子題言詞報告，事先一星期並應提出書面報告，此外，所有修課同學有出席義務及參與討論義務，列入評分項目。此外，本課程時間因為搭配一次研討會或戶外教學，時間於第一次上課時公告，兩次曠課者以不及格論，未能配合者請勿修課。
As far as the seminar is concerned, some participants are required to make an oral presentation and submit a written-form assignment in advance. Furthermore, attendance and discussions are both essential to the course, therefore, those who are unable to meet the requirements and absent from classes for more than two times will be graded as disqualification. Please deliberate whether or not you can comply with above conditions before taking the course. |
